Title 12 Public Ways and Property

Chapter 12.09 Telecommunications, Cable – Municipal Authorization to Use Right-of-way

Section 12.09.020 Purpose
  1. The purposes of this chapter are to:

    1. protect the general public health and safety;

    2. preserve and maintain the primary purpose of the right-of-way and other areas of like use as a means of public access and travel and emergency vehicle access;

    3. comply with requirements of applicable federal or state laws, including chapter 83, Laws of 2000, reserving as well all applicable municipal authority with respect to use and occupancy of the right-of-way and other areas of like use;

    4. preserve the value of the public investment in the right-of-way and other areas of like use, maximize the useful life of street, curbing, and sidewalk paving, and to maintain the integrity and quality of the paving;

    5. support municipal utility and other municipal infrastructure needs as a priority use of the right-of-way and other areas of like use, and the value of municipal infrastructure investment; and

    6. promote a healthy urban environment and the public convenience and aesthetics.
       
  2. The purposes stated govern questions of interpretation and enforcement of this chapter, as implemented in the sound discretion of the administering officer. Notwithstanding any other provision, nothing in this chapter or any municipal action or inaction relating thereto is intended to create or expand any specific municipal duty or liability to any particular person or group or otherwise create or expand municipal tort liability for any purpose. This provision shall control all others in the event of conflict or ambiguity.
