Chapter 17D.090 Erosion and Sediment Control

Section 17D.090.040 Applicability
  1. This chapter applies to all ground-disturbing activities whether or not a permit is required, unless such activities are otherwise exempted herein. As a condition of issuance of any permits involving activities or matters regulated by this chapter, compliance with the provisions of this chapter, including the referenced regulation manuals in SMC 17D.090.030 is required. All ground-disturbing activities that do not require a permit are also subject to this chapter, including referenced regulation manuals. Although a ground-disturbing activity may not require a permit from the City of Spokane, a permit may be required from state and/or federal agencies.
     
  2. Wherever the requirements of this chapter apply to any other separate municipal permit authority, they are incorporated therein, as additional permit conditions. Such permit authority includes but is not limited to building or other permits issued by the building services department, permits issued by the planning and economic development services department, and permits issued by the engineering services department.
  1. Whenever conduct regulated by this chapter falls outside a specific municipal regulatory program, it is a violation of this chapter otherwise to engage in any conduct or refrain from acting in accord with the applicable requirements of this chapter.
     
  2. No ground-disturbing activities shall occur on any property until all final grading, erosion sediment control and bonding requirements have been accepted by the director in accord with this chapter. As used herein unless otherwise specified, “director” means the director of wastewater management. Said director may delegate functions as desired, subject to said official’s overall authority as provided in SMC 17A.010.070(A)(5).
