Chapter 12.01 Improvement, Maintenance of Public Ways
Section 12.01.010 Sidewalk Maintenance – Ow
ne r’s Responsibility
Every owne r and occupant of premises shall keep the sidewalk area including tree grates adjacent to any portion of the real property (including corne rs) in good and safe condition and repair at all times.
Where the Director of Engine ering Services determine s there has been a failure to comply with this section, the Director or their designe e may send written notice to the premises advising of the violation. If the violation is not corrected, the Director or their designe e may proceed to remove or repair the condition, at the owne r’s and/or occupant’s sole expense and liability.
The Directors of Engine ering Services, Development Services Code Enforcement and Parking Services, and the City Engine er are authorized to waive license, bonding, and insurance requirements for minor repairs on existing sidewalks.
The City Engine er, along with the Development Services and the Code Enforcement and Parking Services departments, shall develop and publish a public rule defining the types of sidewalk projects that qualify as minor repairs.
Nothing in this section shall be construed to waive building and construction permit and inspection requirements.
