Section 13.04.0802 Separate
Serv ice
Each building serv ed must have a separate connection and separate meter unless otherwise specifically authorized by the director, but such privilege may be revoked at any time by the director for any reason.
Serv ice connections are provided to the public water system in the public right-of-way unless otherwise approved.
The director may waive the requirement in cases of two or more adjacent buildings under a common ownership or for other good reasons consistent with the public health and safety (e.g. no accessible water main on abutting streets).
The director may further require the property owner(s) to execute and record at their expense an easement appurtenant to and for the benefit of parcels serv ed by the serv ice main on a form supplied by the director, allowing perpetual access to said serv ice main by parcels serv ed and mutually covenanting to maintain said serv ice main for the enjoyment of all such premises.
Said easement shall prohibit construction over or interference with the easement area and shall not be subject to revocation without the written approval of the director.
The City shall have no repair or maintenance obligations as to any such serv ice main.
Where the requirement of the prior paragraph is waived because of common ownership, the waiver expires automatically when premises or buildings are separately owned, unless affirmatively extended by the director.
Exceptions to the requirement of separate connection may be revoked by the director without cost or liability to the City and the premises/building serv ed shall thereafter be required to make a separate connection and install a separate meter at the property owner’s sole expense and liability.
