Article VI. Land Use and Occupancy

Section 08.02.068 Obstruction from Vegetation and Debris

  1. There may be charged against the property owner of the adjacent right of way an assessment for all costs and expenses incurred by the City in administration and enforcement of the abatement of obstruction of the public right of way from vegetation and debris under SMC 12.02.0210.

  2. Costs charged to the property owner include costs incurred by the City including direct action by City forces or contract for the removal or destruction of such vegetation and debris.

  3. In addition to the costs outlined in subsection (B) of this section, a surcharge of eighty-five dollars per instance for the removal of the vegetation will be charged to defray administrative support and related costs for providing this service.

  4. Costs will be billed to the owner of the property or as a utility service to the property as provided in SMC 12.02.0210(A)(2).
