Chapter 17C.355A Wireless Communication Facilities

Section 17C.355A.140 Exempt Facilities

The following are exempt from this chapter:

  1. FCC licensed amateur (ham) radio facilities;

  2. Satellite earth stations, dishes and/or antennas used for private television reception not exceeding one (1) meter in diameter;

  3. A government-owned WCF installed upon the declaration of a state of emergency by the federal, state or local government, or a written determination of public necessity by the City; except that such facility must comply with all federal and state requirements. The WCF shall be exempt from the provisions of this chapter for up to one week after the duration of the state of emergency; and

  4. A temporary, commercial WCF installed for providing coverage of a special event such as news coverage or sporting event, subject to approval by the City. The WCF shall be exempt from the provisions of this chapter for up to one week before and after the duration of the special event.

  5. In locations more than 150 feet from a residential zone, other temporary, commercial WCFs installed for a period of 90 days, subject to renewals at the City’s discretion; provided, that such temporary WCF will comply with applicable setbacks and height requirements.

  6. Eligible Facilities Requests permitted under Chapter 17C.356 SMC.

Section 17C.355A.140 Exempt Facilities
