Chapter 17D.060 Stormwater Facilities

Section 17D.060.040 Establishment of Regional Facilities

In the event that public benefit would accrue due to modification of the natural location of drainage systems, or the modification of drainage plans for specific developments, to better implement the recommendations of the comprehensive drainage plan, the director of wastewater management may recommend that the City assume responsibility for the further design, construction, operation and/or maintenance of the drainage facilities, or any increment of the responsibility for the facilities, on a specific development property. The decision shall be made concurrently with review and approval of the specific development’s drainage plan. In the event that the City decides to assume responsibility for all or any portion of the design, construction, operation, and maintenance of the drainage facilities, the development project sponsor shall be required to contribute a prorated share of the estimated cost of the facilities, provided that such share shall not exceed the estimated costs of improvements the project sponsor would otherwise have been required to install. The project sponsor may be required to supply additional information at the request of the director of wastewater management to aid in such determination.
