Chapter 17D.080 Voluntary Impact Fees

Section 17D.080.090 Credits

  1. In lieu of paying an impact fee a developer may choose to dedicate land subject to approval of the department. The value of the land dedicated offsets or cancels the payment of the impact fee. A dedication of land is valued at fair market value.
     
  2. If pursuant to SEPA a fee is paid in order to mitigate a direct impact of a development, or a fee is paid pursuant to the Local Transportation Act or other statute authorizing the imposition of a fee for direct impacts, the fee assessed under this chapter to mitigate a direct impact is reduced in an equal amount to the fee paid under any other provision of state or local law requiring mitigation payment.
