Chapter 17D.090 Erosion and Sediment Control
Section 17D.090.080 Special Sites
- When the director determines that special site conditions may prevent compliance with the performance standards in SMC 17D.090.180, the director may require a substitute erosion and sediment control plan and/or additional erosion and sediment control measures consistent with the purpose of this chapter and to achieve as nearly as possible the functional equivalent and result of compliance.

Special site conditions may include, but are not limited to, the following:

Slopes before development that are greater than ten percent.

Sites containing highly erosive soils (as mapped on the SCS/NRCS maps).

Slope lengths greater than three hundred feet.

Ground disturbance of a natural vegetative buffer within fifty feet of a wetland or water body.

The development site or development phase will have ground-disturbing activity at any one time of ten thousand square feet or more. Building permits for a single-family dwelling or duplex dwelling are exempt from this size limitation.

Project timing is such that ground disturbing activity will take place between October 1 and April 30; or
- The development involves discharge or off-site disposal of dewatering or trench spoils.
