Chapter 17D.090 Erosion and Sediment Control

Section 17D.090.220 Enforcement Authority – Implementation
  1. The engineering services department may be involved in enforcement of erosion and sediment control standards relating to ground disturbing activities. For commercial development or otherwise, where deemed necessary by the City, issuance of any permit or approval for development is conditioned upon acceptable documentation by a civil engineer licensed by the State of Washington of the following statements under penalty of perjury on such forms as may be supplied by the department:

    1. That the engineer is familiar with all current City of Spokane erosion and sediment control requirements.

    2. That the engineer has personally reviewed the erosion and sediment control plan prepared in connection with any development, has inspected the site and certifies that said plan fulfills the requirements applicable to the pending development; and

    3. That the erosion and sediment control plan for the development meets or exceeds all applicable municipal requirements relating to erosion and sediment control, as designed and functioning.
       
  2. In lieu of such certification, the director may require an inspection for erosion and sediment control compliance by municipal staff.
     
  3. In evaluating decisions under the chapter, the enforcing official may elect to submit any information available to an independent civil engineer selected by the City for review at the City’s expense. An applicant may likewise have such opinion further reviewed by an independent civil engineer licensed to practice in the State of Washington selected by applicant at the applicant’s expense. All final decisions shall be at the enforcing official’s sole discretion.
