Chapter 17E.010 Critical Aquifer Recharge Areas – Aquifer Protection

Article II. Implementation

Section 17E.010.080 Prohibition – Nuisance

  1. The pollution or creation of a substantial risk of pollution of the Spokane aquifer by any proposed or existing land use, installation, or activity is prohibited.
     
  2. The pollution or creation of a substantial risk of pollution of the Spokane aquifer by any proposed or existing land use, installation or activity is declared a public nuisance.
     
  3. In addition to its popular meaning "pollution" herein refers to a seepage, spillage, or other release into the environment of a critical material.
     
  4. An activity, installation or land use may be declared a nuisance by the critical review officer upon a finding that the criteria set forth herein are met.
     
  5. Maintenance of a condition on premises in violation of this chapter or applicable federal or state laws, such as those relating to underground storage tank installations, is designated a public nuisance, which may be abated in any lawful manner in addition to any other applicable penalties or remedies.
