Chapter 17E.060 Shoreline Regulations

Article V. General Requirements for Shoreline Use and Modifications: Part V. Requirements for Specific Shoreline Uses

Section 17E.060.500 Commercial Development
  1. Definition.

Commercial developments are those uses which involve wholesale and retail trade or business activity that meet the definition in SMC 17E.060.370, Primary Permitted Uses, for water-dependent, water-related, water-enjoyment, and non-water oriented uses.

  1. The location, design and construction of commercial uses and redevelopment shall achieve no net loss of ecological functions.
  1. Preference shall be given first to water-dependent commercial uses, then to water-related and water-enjoyment uses.
  1. All commercial uses shall provide public access pursuant to SMC 17E.060.290, Physical and Visual Public Access.
  1. Non-water oriented commercial uses shall not be allowed unless the site is physically separated from the shoreline by another property or public right-of-way or the following criteria are met:
    1. The use is part of a mixed-use project (a combination of non-water oriented uses with any of the following: water-dependent, water-related, or water-enjoyment uses); and
    1. Provides public access and ecological restoration to achieve no net loss of shoreline ecological functions, pursuant to Article III, Part II, No Net Loss of Ecological Functions and Mitigation.
  1. Non-water-dependent commercial uses over water shall be prohibited except in existing structures and where necessary to support water-dependent uses.
