Chapter 17F.010 General Provisions

Section 17F.010.090 Rehearing and Appeal
  1. Subject to any specific provision of this code, each director may provide by rule for the procedures of rehearing, reconsideration and appeal.
  1. Time for Application.

A person seeking to appeal must complete the filing within the time periods as follows:

    1. Model/Development Codes:
      1. A revocation or suspension of a boiler operator’s license to the board of boiler examiners and appeals, as provided in SMC 4.04.100.
      1. A denial or revocation of a mechanic license to the board of heating mechanical examiners, as provided in SMC 4.04.100.
    1. Existing Building and Conservation Code:
      1. An order of the building official to the hearing examiner, in thirty days.
      1. An inspection report to the building official in thirty days.
      1. The decision on a hearing of the building official and fire official to the city council, in ten days.
    1. Judicial Review.

An action to enjoin enforcement of the order of the hearing examiner must be filed within twenty-one days of service of the order.

  1. A person requesting rehearing, reconsideration or appeal must make the request in writing setting forth the grounds or reasons and must comply with such rules as may be adopted.
  1. Unless otherwise ordered by the body to consider the matter, the timely filing of an adequate appeal or request for rehearing or reconsideration operates to stay the order or decision pending final disposition of the appeal or other request for relief, except when the public health or safety requires enforcement of the order.
