Chapter 17I.010 Enforcement

Section 17I.010.010 Penalties and Sanctions

  1. This title requires persons to conform activities to certain standards and also to maintain premises in certain conditions. The failure to rectify unlawful conditions is a continuing offense and subjects the person failing to act to continuing liability for criminal, civil and administrative proceedings and sanctions.
     
  2. Because the requirements of this title constitute reasonable and necessary standards for the preservation and promotion of the public health, safety and general welfare, a violation of this title is deleterious to the public interest and is subject to abatement as a public nuisance.
     
  3. A violation of this title may specially affect the health, safety, prosperity or quiet enjoyment of the owners and occupants of neighboring properties and give rise to private causes of action, but this code does not purport to determine, prescribe or alter the relative rights and liabilities as between individual persons.
     
  4. In addition to any other remedy the City may have, a violation of this title, including rules and regulations duly promulgated hereunder, unless otherwise provided is a criminal offense punishable as provided in SMC 1.02.950.
     
  5. In addition, the premises being used in violation of the land use codes may have their certificate of occupancy revoked.
     
  6. In addition, upon the failure to correct a land use violation in the case of a nonresidential use established under a special permit, plans in lieu of compliance, limited zone, design zone, planned unit development, transfer of development rights or other process whereby development and/or operation are subject to approved plans and agreement, the director may abate the violation by suspending City utility service to the premises.
