Article III. Franchise Conditions
Section 10.27A.400 Subscriber Fees and Rates
The City reserves the right to regulate rates for any service pursuant to changes in federal or state law which would authorize such regulati on. The City reserves the right to establish procedures for any lawful regulati on of rates.
Rates and charges may be reduced at any time without prior City approval, provided that the reductions do not result in rates which are unreasonably discriminatory to any subscriber or class of subscribers.
Where temporary reductions are put into effect for promotional purposes for a specified time period, the return to the permanent rates shall not be considered a rate increase for purposes of this chapter.
Rates and charges not subject to regulati on by the City under state or federal law or regulati on may be changed by a franchisee following a minimum thirty days prior written notice to the City and each subscriber.
If a franchisee’s subscribers are offered a discount for “bundled” services (i.e., subscribers obtain cable services and some other non-cable goods or service) then in no event shall the franchisee be permitted to unlawfully or unreasonably evade or reduce applicable franchise fee payments required to be made to the City due to discounted bundled services.
