Section 10.34A.200 Driver Conduct; Non-Discrimin
ati on and Zero Tolerance Policies
Each for-hire operator licensed under this chapter must maintain and implement a zero tolerance drug and alcohol policy and a nondiscriminati on policy regarding its affiliated drivers. The non-discriminati on policy shall prohibit all forms of discriminati on as the same is defined in SMC 18.01.030(D).
Copies of the zero tolerance and nondiscriminati on policies must be provided by the for-hire operator to the licensing officer and each affiliated driver and must be accessible via a dedicated web page, on the TNC’s digital network, or at the for-hire operator’s principal place of business.
Each for-hire operator licensed under this chapter shall provide notice to passengers of the zero tolerance and nondiscriminati on policies, as well as procedures to report a complaint about a driver whom the passenger reasonably suspects was under the influence of drugs or alcohol during the course of the trip or who violated the nondiscriminati on policy.
If a for-hire operator determines that a driver has violated the zero tolerance or nondiscriminati on policy, the for-hire operator must take appropriate action against the driver, which action may include suspending or removing the driver from the TNC’s digital network or the taxi operator’s dispatch service until the for-hire operator determines that the driver is in compliance with the zero tolerance and nondiscriminati on policy.
Each for-hire operator and driver licensed under this chapter shall comply with all applicable laws relati ng to the transportati on of service animals.
No individual or entity holding a license under this chapter may impose additional charges for providing services to persons with disabilities because of those disabilities.
