Chapter 12.03 Airport Regulations

Article III. Solicitation Activities

Section 12.03.0408 Appeal
  1. Upon notification of the denial of a permit required by SMC 12.03.0402(A), or revocation thereof, an applicant may, but is not required to, file with the office of the airport’s director a notice of appeal to the Spokane airport board. Upon receipt of a notice of appeal, the airport’s director shall suspend efforts to obtain a judicial determination of the validity of the denial or moratorium of the permit as required by SMC 12.03.0406(B), until the notice of appeal is withdrawn or until the denial or revocation of the permit is determined by the Spokane airport board.
     
  2. Upon receipt of the notice of appeal, the airport’s director shall set the matter for a hearing before the Spokane airport board within ten days thereof and shall issue a notice of hearing which shall be sent by certified mail, return receipt requested, to the applicant and which shall contain the time and place of the hearing.
     
  3. At the hearing the applicant may be represented by counsel. Testimony shall be taken upon oath or affirmation first of witnesses in support of the denial of the permit. The applicant may testify and present witnesses on his behalf. A court reporter record shall be made of the proceeding. A record shall be kept of all evidence received or considered in addition to the oral testimony.
     
  4. The findings and order of the Spokane airport board shall, within five calendar days of the conclusion of the hearing, be forthwith sent to the applicant by certified mail, return receipt requested. If the denial of the permit is upheld by the Spokane airport board or if the notice of appeal is withdrawn prior to a final determination of the issue by the Spokane airport board, the airport’s director shall undertake to obtain a judicial determination of the validity of the denial of the permit as required by SMC 12.03.0406(B).
