Article III. Wastewater Discharge Permit
Section 13.03A.0311 Permit Transfer [3.11]
Upon written approval of the Plant Manager, discharge permits may be transferred to a new owner or operator. An applicant must give at least thirty days advance notice to the Plant Manager. Applicati ons must be filed with the Plant Manager, upon such forms and with such informati on as required by the Plant Manager, signed by an authorized representati ve and certified as provided in SMC 13.03A.0305(B) , and include the fee as provided in SMC 13.03A.1401 .
Applicati ons must include a written statement by an authorized representati ve of the transferee, signed under penalty of perjury of the laws of the State of Washington or the state of residence of the signatory which:
states that the transferee applicant has no plans to change the facility’s operati ons and processes;
acknowledges the obligati on to apply for a discharge permit modificati on in writing should any such change be planned prior to implementing such change;
identifies the specific date on which the transfer is requested to occur; and
acknowledges full responsibility for complying with the existing discharge permit;
permit modificati on requests must address changes in slug control plans and industrial stormwater.
If there are no changes in the facility, operati on, or discharge and proper advance notice was given, the Plant Manager may consider the transferee as an existing user upon sati sfaction of the conditions of this section. If a transfer request is not submitted as required, the permit expires and a new applicati on must be made. The Plant Manager may impose any temporary conditions on continuing discharge of permit expiring under this provision until a new permit is obtained.
