Chapter 17E.030 Floodplain Management

Section 17E.030.180 Penalties for Noncompliance

No structure or land shall hereafter be constructed, located, extended, converted or altered without full compliance with the terms of this chapter and other applicable regulations. Violations of the provisions of this chapter by failure to comply with any of its requirements (including violations of conditions and safeguards established in connection with conditions) shall constitute a civil violation and shall constitute a separate offense each day during which the violation exists. Any person who violates this chapter or fails to comply with any of its requirements shall be liable for a penalty, as set forth in SMC 1.05.160, for each violation except the violations will accrue according to this section, and in addition shall pay all costs and expenses involved in the case. Penalty for a violation of a variance permit issued under this chapter will be two hundred fifty dollars each violation. Every structure, building, fill, or development placed within any flood zone contrary to the terms of this chapter is deemed by the City to be a public nuisance and danger, and may be enjoined and abated in appropriate court of law. Nothing herein contained shall prevent the city from taking such other lawful action as is necessary to prevent or remedy any violation.
