Chapter 17E.060 Shoreline Regulations

Article III. General Provisions: Part II. No Net Loss of Shoreline Ecological Functions and Mitigation

Section 17E.060.220 Mitigation Sequencing
  1. Purpose.

To achieve no net loss of shoreline ecological functions, applicants for a proposed use, modification, or development within the shoreline jurisdiction shall analyze the impacts of the proposal on the shoreline ecological functions and include measures to mitigate environmental impacts not otherwise avoided or mitigated by compliance with the shoreline regulations or other applicable regulations, including the Washington State Environmental Policy Act (SEPA).

  1. Mitigation shall occur in the following prioritized order:
    1. Avoiding the impact altogether by not taking a certain action or parts of an action.
    1. Minimizing impacts by limiting the degree or magnitude of the action and its implementation, by using appropriate technology, or by taking affirmative steps to avoid or reduce impacts.
    1. Rectifying the impact by repairing, rehabilitating or restoring the affected environment.
    1. Reducing or eliminating the impact over time by preservation and maintenance operations during the life of the action.
    1. Compensating for the impact by restoring, rehabilitating, or enhancing substitute shoreline environments; or
    1. Monitoring the impact and the compensation project and taking appropriate corrective measures.
  1. Mitigation may include a combination of the measures in subsections (B)(1) to (B)(6) above.
  1. As a condition of any permit or approval allowing alteration of shoreline ecological functions, the applicant shall engage in the restoration, rehabilitation, or enhancement of the shoreline environment in order to offset the impacts resulting from the applicant’s actions.
