Article VIII. Bid der Responsibility
Section 07.06.540 Definitions
If the City determines the low bid der does not meet the supplemental bid der criteria as outlined and is therefore not a responsible bid der, the City shall notify the bid der in writing with the reasons for its determination. If the bid der disagrees with the City’s determination, the bid der will have a minimum of three (3) business days to submit additional written information to the City. The City will consider any timely submitted additional information received from bid der before issuing its subsequent determination. If the bid der disagrees with the City’s determination, it may appeal that determination to the Mayor or his/her designee in writing within two (2) business days of receiving the City’s determination (the appeal shall be filed with the Purchasing Division). The Mayor or his/her designee shall make a final determination on the appeal and will include that decision in the staff report to the City Council as the awarding authority. If the bid der is ultimately determined not responsible, the City will not execute a contract with any other bid der until at least two (2) business days after the bid award.
