Chapter 07.06 Procurement of Goods, Services and Works

Article II. Public Bidding and Other Provisions

Section 07.06.180 Emergency Procurement

  

  1. The City Council, by resolution may waive competitive bid requirements for procurement of goods, Public Works and services above the minor contract threshold in the event of an emergency.
  1. If the emergency requires procurements above the minor contract threshold prior to City Council action, the Mayor, consistent with Chapter 02.04 SMC, may declare an emergency situation exists, waive public bidding requirements, and award all necessary contracts on behalf of the City to address the emergency situation. Contracts awarded pursuant to this subsection shall be presented to the Council for ratification through a resolution. All contracts awarded pursuant to this subsection shall be filed with the City Clerk within five (5) business days of execution. If the Council votes against ratification of a contract, the contract shall become void and the contractor shall be paid for actual costs incurred for performance of the contract through the date of the Council’s vote
  2. Departments may enter into contracts not to exceed the minor contract threshold as an emergency procurement without competitive procurement and without a mayoral emergency declaration or council approval if:
    1. A written statement of findings of the emergency is filed with the City Clerk within two (2) weeks of execution of the emergency minor contract; and
    1. The City Council is provided copies of the emergency minor contract and related information by the Purchasing Department no later than thirty (30) days after execution of the contract; and
    1. The procurement is made pursuant to emergency procurement procedures established by the Purchasing Department.
  1. Force account work by City crews shall be in accordance with state law.
  1. Emergency procurements are made with such competition as is practicable under the circumstances.
