Chapter 10.27A Cable Communications Code

Article II. Franchise Applications

Section 10.27A.200 Filing of Applications

Applications for a cable communications franchise will be considered pursuant to the following procedures:

  1. An application may be filed at any time or pursuant to a request for proposals (RFP) issued by the City.
  1. The City may request additional information from an applicant for a franchise at any time.
  1. All applications to be acceptable for filing must be accompanied by a filing fee of ten thousand dollars or such other sum as determined in City’s sole discretion.
    1. The City shall apply all filing fees received against all costs associated with its evaluation of any pending application(s) pursuant to SMC 10.27A.240.
    1. In the event that total costs are less than total filing fees, the City may refund a portion of the filing fee on a pro rata basis to each applicant.
    1. To the extent permissible under applicable law, the City reserves the right to impose a fee to fully recoup the costs associated with processing an application, including staff time and expenses.
    1. The City may require supplemental payments where deemed necessary as a condition of continuing to process an application.
