iv er Conduct; Non-Discrimination and Zero Tolerance Policies
Each for-hire operator licensed under this chapter must maintain and implement a zero tolerance drug and alcohol policy and a nondiscrimination policy regarding its affiliated driv ers. The non-discrimination policy shall prohibit all forms of discrimination as the same is defined in SMC 18.01.030(D).
Copies of the zero tolerance and nondiscrimination policies must be provided by the for-hire operator to the licensing officer and each affiliated driv er and must be accessible via a dedicated web page, on the TNC’s digital network, or at the for-hire operator’s principal place of business.
Each for-hire operator licensed under this chapter shall provide notice to passengers of the zero tolerance and nondiscrimination policies, as well as procedures to report a complaint about a driv er whom the passenger reasonably suspects was under the influence of drugs or alcohol during the course of the trip or who violated the nondiscrimination policy.
If a for-hire operator determines that a driv er has violated the zero tolerance or nondiscrimination policy, the for-hire operator must take appropriate action against the driv er, which action may include suspending or removing the driv er from the TNC’s digital network or the taxi operator’s dispatch service until the for-hire operator determines that the driv er is in compliance with the zero tolerance and nondiscrimination policy.
Each for-hire operator and driv er licensed under this chapter shall comply with all applicable laws relating to the transportation of service animals.
No indiv idual or entity holding a license under this chapter may impose additional charges for providing services to persons with disabilities because of those disabilities.
