Chapter 10.39 Special Events
Section 10.39.080 Insurance Required to Conduct Special Event
The applicant for special event permit must possess or obtain comprehensiv e general liability insurance in the amount of single limit coverage of at least one million dollars to protect the City against loss from liability imposed by law for damages on account of bodily damage and/or property damage arising from the special event.
The insurance shall name the City of Spokane, its officers, employees and agents as additional insured.
Insurance coverage must be maintained for the duration of the special event.
Notice of cancellation of insurance must be provided immediately to the City.
The certificate of insurance shall be giv en to the City license officer and reviewed by the City risk manager no less than thirty days prior to the special event, and no less than seven days if it is an expressiv e activ ity event.
The risk manager may authorize a greater or lesser amount of coverage or different type of coverage than required by subsection (A) of this section if the special event is of a demonstrated high- or low-risk category, according to recognized insurance and risk management industry standards.
The City shall not consider the potential reaction of bystanders to the content of expressiv e activ ity for purposes of costs assessed to the applicant; likewise, the City shall not consider the potential reaction of bystanders to the content of expressiv e activ ity, as defined above, as a factor in requiring insurance coverage.
Waiv er of the insurance requirement shall be made if the event is solely for expressiv e activ ity, provided that the applicant has filed with the licensing officer a verified statement that he intends the special event purpose to be a First Amendment expression and the cost of obtaining insurance is financially burdensome.
Waiv er of the insurance requirement shall also be made if it is objectiv ely impossible to obtain insurance coverage demonstrated by the applicant’s submittal of two statements from independent licensed insurance brokers stating that the insurance is unavailable.
Waiv er of insurance shall not impose any greater liability on the City nor create any greater duty on the City than that proscribed by law.
