Section 17E.060.500 Commercial Development
Definition.
Commercial developments are those uses which involve wholesale and retail trade or business activ ity that meet the definition in SMC 17E.060.370 , Primary Permitted Uses, for water-dependent, water-related, water-enjoyment, and non-water oriented uses.
The location, design and construction of commercial uses and redevelopment shall achieve no net loss of ecological functions.
Preference shall be giv en first to water-dependent commercial uses, then to water-related and water-enjoyment uses.
All commercial uses shall provide public access pursuant to SMC 17E.060.290 , Physical and Visual Public Access.
Non-water oriented commercial uses shall not be allowed unless the site is physically separated from the shoreline by another property or public right-of-way or the following criteria are met:
The use is part of a mixed-use project (a combination of non-water oriented uses with any of the following: water-dependent, water-related, or water-enjoyment uses); and
Provides public access and ecological restoration to achieve no net loss of shoreline ecological functions, pursuant to Article III, Part II , No Net Loss of Ecological Functions and Mitigation.
Non-water-dependent commercial uses over water shall be prohibited except in existing structures and where necessary to support water-dependent uses.
