Article IV. Hearing Provisions

Section 07.05.440 Notice – Local Improvement District Formation Hearing
  1. The engineering services department, at least fifteen days prior to the date set for the hearing, mails notice of the hearing on the formation of the local improvement district to all owners and reputed owners of property within the boundaries of the proposed local improvement district.
  1. The engineering services department causes notice of the formation hearing to be published in at least two consecutive issues of the official newspaper of the City, the first publication to be at least fifteen days prior to the date set for the hearing.
  1. The mailed notice contains at least the following information:
    1. Description of the proposed improvement.
    1. Statement that a description of the proposed district boundaries is available in the public works department.
    1. Estimated cost of the proposed improvement.
    1. Statement that actual assessments may vary from assessment estimates so long as they do not exceed a figure equal to the increased true and fair value the improvement adds to the property.
    1. Estimated special benefits to the particular lot, tract or parcel resulting from the proposed local improvement.
    1. Time and place of the hearing.
    1. Statement that anyone may testify at the hearing.
    1. Statement that written comments on the proposed improvement will be accepted.
    1. Statement that the hearing before the hearing examiner shall be the only hearing held on the formation of the proposed local improvement district and that the city council will act on the hearing examiner’s recommendation based on the record.
    1. Statement that a copy of the report of the engineering services department to the hearing examiner may be obtained at the engineering services department within seven days prior to the hearing.
    1. Office address and telephone number of the individual in the engineering services department from whom additional information may be obtained.
  1. The published notice contains at least the following information:
    1. Full text of the initiating resolution; and
    1. As provided in subsections (C)(8) through (C)(10) of this section.
