Chapter 07.06 Procurement of Goods, Services and Works

Article VII. Municipal Art Policy

Section 07.06.425 1% for Public Art Program

 

  1. Beginning in the 2027-2032 Citywide Capital Improvement Program, all new qualifying capital improvement projects, as defined in SMC 07.06.410, shall include one percent (1%) of the estimated project cost for the acquisition, installation, and maintenance of works of art. The equivalent of one percent (1%) of the executed construction contract of the qualifying capital improvement project shall be transferred to the Public Art Project Fund for purposes authorized in SMC 7.08.106 upon the execution of the project. The one percent (1%) shall not apply to contract amendments, change orders, or the qualifying capital improvement project’s administrative reserves.
  2. Nothing shall preclude a requesting department from incorporating works of art into capital improvement projects approved prior to the adoption of the 2027-2032 Citywide Capital Improvement Program.
  3. The execution and placement of art projects supported by funds transferred to the Public Art Project Fund is led by the Arts, Culture, and Historic Preservation Department in consultation with the Spokane Arts Commission and the department leading the qualifying capital improvement project, where applicable. 
  4. Transfer of funds to the Public Art Project Fund remains subject to any restrictions or requirements applicable to uses of the funds in contract or law, such as applicable requirements as may arise under RCW 43.09.210 or from funding or grant sources. The department that originated the qualifying capital improvement project may also propose additional restrictions.
  5. The Arts, Culture, and Historic Preservation Department, in consultation with the Spokane Arts Commission, shall develop criteria for use of or access to funds transferred to the Public Art Project Fund. The criteria for the selection of art funded through the Public Art Project Fund shall include, but are not limited to:
    1. accessibility of the work to the community (e.g., placement in parks, publicly accessible corridors, community gathering places, and public buildings or other zones of public interaction);
    2. compatibility with the Comprehensive Plan, Downtown Plan, and other neighborhood plans; and
    3. art proposed to be placed in City parks shall further be subject to approval of the Park Board.
    4. art in libraries shall further be subject to approval of the Spokane Public Library Board of Trustees.
    5. the Arts, Culture, and Historic Preservation Department may also consider the advice of other jurisdictional bodies such as neighborhood councils, Landmarks Commission, business improvement district ratepayer advisory boards, or similar bodies exercising oversight or advisory over affected areas. 
  6. All selection and placement of art shall be subject to the judgment and discretion of the Spokane Arts Commission in consultation with the Arts, Culture, and Historic Preservation Department and the department leading the qualifying capital improvement project.
