Article VIII. Bidder Responsibility
Section 07.06.540 Definitions
If the City determines the low bidder does not meet the supplemental bidder criteria as outlined and is therefore not a responsible bidder, the City shall notify the bidder in writing with the reasons for its determination. If the bidder disagrees with the City’s determination, the bidder will have a minimum of three (3) business days to submit additional written information to the City. The City will consider any timely submitted additional information received from bidder before issuing its subsequent determination. If the bidder disagrees with the City’s determination, it may appeal that determination to the Mayor or his/her designee in writing within two (2) business days of receiving the City’s determination (the appeal shall be filed with the Purchasing Division). The Mayor or his/her designee shall make a final determination on the appeal and will include that decision in the staff report to the City Council as the awarding authority. If the bidder is ultimately determined not responsible, the City will not execute a contract with any other bidder until at least two (2) business days after the bid award.
