Chapter 13.02 Solid Waste
Article II. General Provisions
Section 13.02.0206 Authority of the Di
rec tor
Purpose.
Considering:
the Spokane solid waste plan;
chapter 70.95 RCW;
the public health and safety;
the means to assure prompt, safe, and efficient delivery of solid waste collection and disposal services to the public; and
the conservation of public moneys;
the direc tor administers and interprets this chapter and the operations and functions of the department, and determines all questions arising hereunder. The direc tor exercises general administrative authority with respect to all departmental operations either direc tly or through persons he may designate. The direc tor may modify or adjust provisions of departmental functions consistent with sound business management practice.
Regulations.
The direc tor may promulgate regulations in the enforcement of this chapter, considering the purpose of this section.
Warnings – Orders.
The direc tor may issue warning notices and enforcement orders upon such reasonable notice as the direc tor deems proper. The direc tor may take such remedial measures as the direc tor deems necessary, including issuing civil infractions to enforce any order, regulation or provision of this chapter, including clean-up operations.
Procedures.
The direc tor may establish procedures to resolve disputed questions of fact or liability within the scope of the direc tor’s authority and may subpoena witnesses, take testimony, require the submission of verified statements, rec ords, and samples, but no formal proceedings or notice shall be a prec ondition of any action taken.
Violations of a direc tor’s order are a class 1 civil infraction. Said penalties are in addition to actual costs of clean-up or other services provided by the City.
