Article XI. Rates
Section 13.03.1138 “User Charge”
“User Charge” means the charge required to cover the costs of collection and treatment of wa stewa ters discharged to the Spokane wa stewa ter treatment system, including treatment of the wa stewa ter to remove:
suspended solids (SS),
biochemical oxygen demand (BOD), and
phosphorus (P),
as necessary to meet the standards established under state and federal law for municipal sewa ge effluent, as set forth in the City of Spokane’s NPDES wa stewa ter disposal permit, and the costs for the disposal of treated wa stewa ter and any residuals.
The user charge rates shall be reviewed and may be adjusted annually by the director, subject to the approval of the city council, to accurately reflect the costs for treating each unit volume of wa stewa ter and unit quantity of the above constituents, as necessary to comply with the requirements of the City of Spokane’s NPDES wa stewa ter discharge permit.
The user charge will consist of a charge calculated by the director for the treatment and disposal of discharges of standard wa stewa ter strength, plus a surcharge to be applied to commercial user and industrial user sewer service accounts based upon the quality of constituent pollutants: BOD, SS or P, in the wa stewa ter strength (SMC 13.03.1006 ).
The amount of the surcharge shall be determined by an analysis, by the director, of the wa stewa ter being discharged by specific commercial and industrial users.
