Chapter 17D.090 Erosion and Sediment Control

Section 17D.090.010 Purpose
  1. The purpose of this chapter is to establish a soil erosion and sedimentation control (ESC) program for ground-disturbing activities. The City ESC program is part of an overall stormwater management program implemented by the City and required by state and federal law. Many of the details of the City ESC program are specified in the referenced regulation manuals and materials listed in SMC 17D.090.030. All materials are subject to change from time to time.
  1. The City ESC program establishes erosion and sediment control practices. Such practices aim to:
    1. minimize the sediment and pollutants contained in erosion caused by construction and development;
    1. minimize the amount of sediment and pollutants entering storm drainage systems and surface waters from all ground disturbing activity;
    1. minimize the amount of erosion placing dirt and mud on the public right-of-way and surrounding properties during and after construction and development;
    1. minimize the amount of soil and dust placed into the air during ground disturbing activity;
    1. minimize the demand for costly or unnecessary maintenance and repairs to public infrastructure, roads, embankments, ditches, streams, lakes, wetlands, and stormwater control facilities which are a result of excessive or preventable soil erosion and inadequate stormwater runoff control;
    1. assure the City’s compliance with any applicable requirements of state law, including the National Pollutant Discharge Elimination System – Eastern Washington Phase II Municipal Stormwater Permit (WAR 04-6505) as approved by the Washington State department of ecology; and
    1. avoid danger or damage to property or persons.
  1. Notwithstanding any other provision, no special duty to any person or class shall ever be deemed created by any part of this chapter. Any duty nonetheless deemed created shall be deemed exclusively to be a general duty to the general public.
