Section 01.02.080 “Officer” Defined
- An “officer” is an individual who has the authority to act on behalf of, and whose act constitutes the act of, a corporation or other association. “Officer” also includes each member of a governing body invested with power to take action having legal effect.
- Such terms as “official,” “manager,” “managing agent,” “executive,” and “officer” are generally synonymous and refer to a person acting within the scope of his actual authority, which authority partakes of judgment, discretion, or policy, as opposed to clerical or ministerial functions.
- Officers of the City include:
- members of the city council (Charter Article III);
- the mayor, city administrator, and division directors (Charter Article IV; chapter 3.01 SMC);
- department heads (chapter 01 SMC);
- the city attorney, an assistant city attorney, and a special counsel (Charter section 29, Charter section 32, Charter section 33);
- hearing examiner (chapter 17G.050 SMC);
- members of the:

- building and construction review and examining boards, and hearing officers (chapter 4.06 SMC);

- civil service commission (Charter Article VI);
-
- design review board (chapter 4.13 SMC);
-
- human rights commission (chapter 4.10 SMC);

- park board (Charter Article V, chapter 4.11 SMC);

- plan commission (Charter Article XV, chapter 4.12 SMC); and
-
- urban forestry tree committee when acting within the bounds of jurisdiction in the particular instance.
