Section 07.05.490 Criteria for Local Improvement District Formation Recommendation
The hearing examiner does not recommend approval of the formation of a local improvement district, and the city council does not pass the ordinance creating the local improvement district, unless it is determined that:
- all property that will be benefited by the proposed improvement is included within the proposed boundaries of the local improvement district;
- only property that will be benefited by the proposed improvement is included within the proposed boundaries of the local improvement district;
- formation of the local improvement district is consistent with the adopted policies of the city council; and
- all procedures set forth in chapter 35.43 RCW and this article have been followed.
