Article X. Judicial Remedies
Section 13.03A.1003 Criminal Prosecution [10.3]
- A user which has willfully or negligently violated any provision of this chapter, a discharge permit, or order issued hereunder, or any other pretreatment standard or requirement shall, upon conviction, be guilty of a gross misdemeanor, punishable by a fine of not more than ten thousand dollars per violation per day and the costs for prosecution, and or imprisonment for not more than three hundred sixty-four days, or by both.
- A user which has willfully or negligently introduced any substance into the POTW which causes personal injury or property damage shall, upon conviction, be guilty of a gross misdemeanor and be subject to a penalty of up to ten thousand dollars per violation per day and the costs of prosecution, and/or be subject to imprisonment for up to three hundred sixty-four days, or by both. This penalty shall be in addition to any other cause of action for personal injury or property damage available under state law.
- A user which knowingly made any false statements, representation, or certification in any application, record, report, plan, or other documentation filed, or required to be maintained, pursuant to this chapter, discharge permit, or order issued hereunder, or who falsified, tampered with, or knowingly rendered inaccurate any monitoring device or method required under this chapter shall, upon conviction, be guilty of a gross misdemeanor and be subject to a penalty of up to ten thousand dollars and the costs of prosecution, per violation per day, and/or be subject to imprisonment for up to three hundred sixty-four days, or by both.
