Chapter 17A.010 General Administration
Section 17A.010.050 Conflict between Chapters
- Should it appear that a conflict exists between the substantive or procedural provisions of a chapter of this code and another chapter, or between a chapter of this code and a provision of state or federal law, that provision that imposes the more stringent regulation shall control, unless the state or federal law in question clearly expresses preemption or non-preemption.
- As provided by the State Building Code, SMC chapters 17F.040, Building Code; 17F.090, Mechanical Code; 17F.080, Fire Code; and 17F.100, Plumbing Code; control in the order listed.
- Because mandated by state law, chapter 17E.060 SMC has priority over purely local laws.
- A specific provision in a section or chapter applicable to a particular circumstance controls in case of conflict over a corresponding provision of general application.
- Conflicts with State Energy Code.

- In the case of conflict between the ventilation requirements of IBC Section 1205 and the ventilation requirements of the State Energy Code, the State Energy Code governs.

- In the case of conflict between the duct insulation requirements of IMC Section 604 and the duct insulation requirements of the State Energy Code, the State Energy Code governs.
