Chapter 17A.060 Development Agreements
Section 17A.060.010 Development Agreements Authorized
- Property Within City Limits.
The City may enter into a development agreement pursuant to this chapter 17A.060 SMC and RCW 36.70B.170 et seq., with a person having ownership or control of real property within its jurisdiction.
- Property Outside City Limits.
The City may enter into a development agreement pursuant to this chapter 17A.060 SMC and RCW 36.70B.170 et seq., with a person having ownership or control of real property outside of its boundaries as part of a proposed annexation or service agreement.
- Nature of City Action.
The execution of a development agreement in and of itself is an administrative act, as opposed to a quasi-judicial or a legislative act, and is a proper exercise of the City’s police power and contract authority.
