Chapter 17C.210 Nonconforming Situations
Section 17C.210.030 Nonconforming Uses – Lapse of Rights
- Any nonconforming use which is discontinued for a period of two years and any use which requires a conditional use permit upon expiration of the special permit or conditional use permit loses all rights to continue under this chapter.
- Whenever a matter before the hearing examiner involves a nonconforming use, the examiner, using whatever information is available, determines whether a nonconforming use has been abandoned as provided in subsection (A) of this section.
