Chapter 17E.040 Spokane Geologically Hazardous Areas

Section 17E.040.020 Applicability

1. This chapter shall apply to all activities and development occurring in a geologically hazardous area and associated buffers as defined in this chapter. Property located in a geologically hazardous area and/or associated buffer is subject to both its zoning classification regulations and to the additional requirements imposed under this chapter. In any case where there are differences between the provisions of the underlying zone and this chapter, the provisions of this chapter shall apply.

2. Geologically hazardous areas are those areas that because of their susceptibility to erosion, sliding, earthquake or other geological events are not suited to the siting of commercial, industrial or residential development consistent with public health and/or safety concerns. All areas within the City meeting this definition are hereby designated critical areas and are subject to the provisions of this chapter.

3. No action shall be undertaken by any person that results in the alteration of geologically hazardous areas as defined in this chapter except in conformance with this chapter. Uses and activities are allowed in geologically hazardous areas only if the use or activity is in compliance with:
