Chapter 17F.070 Existing Building and Conservation Code

Section 17F.070.440 Departmental Hearing
  1. Unless arrangements satisfactory to the director of building services are made for the repair, vacation, demolition, or other necessary disposition of the property prior to the time fixed in the complaint under SMC 17F.070.420(A) for the hearing, the director holds a hearing. Based on the complaint, any answer to the complaint and any evidence presented, the director:
    1. determines whether the building is boarded up, substandard, unfit, abandoned, or otherwise a nuisance and subject to an annual hearing processing fee. This fee may be assessed annually after a hearing to determine if the building remains as a boarded up, substandard, unfit, abandoned, or nuisance. The building official may also assess the annual monitoring fee if the building is abandoned, unsecured, or otherwise a nuisance ;
    1. determines what action must be taken by the owner (such as repair and rehabilitation, vacation, demolition) to render the property in compliance with this chapter; and
    1. after the hearing, prepares in writing findings in support of his determinations and an order directing the owner to take specified corrective action within a specified time.
  1. An interested person may appeal an inspection report regarding apartment and hotel buildings over two stories in height under SMC 17F.070.420(B) to the director of building services and fire official by filing, within thirty days of service, with the director a written notice of appeal, specifying the provisions appealed from and the grounds of the appeal. If an appeal is filed, the director and fire official set a time and place for hearing, within fifteen days unless otherwise agreed to, and advise the appellant by any appropriate means. Based on the evidence at the hearing the director and the fire official may:
    1. affirm or reverse the findings or rulings in the inspection report;
    1. grant a variance; or
    1. make some adjustment of the required corrective action or the time for corrective action, imposing such conditions as necessary to assure reasonable safety.
