Section 01.04B.180 Commencement of Proceedings
- Within 30 calendar days of receiving an investigative report recommending that hearing be held, the Ethics Commission shall conduct a formal hearing to determine whether an ethics violation has occurred as alleged in the complaint.
- At the hearing, the Ethics Commission may consider the findings contained within the investigative report submitted by the independent investigator and may also consider testimony taken from witnesses and any other evidence presented at the hearing.
- The Ethics Commission may determine that additional evidence is necessary to establish the factual record, in which case it may issue a prehearing order calling for witness testimony.
