Part 5 – Appeal

Section 01.04B.220 Notice of Appeal
  1. Any person who has been found to have violated this chapter and has been assessed a monetary penalty, subjected to disciplinary action, or removed from office for a violation of this chapter may file an appeal to the City’s Hearing Examiner by delivering a written notice of appeal to the City Clerk’s Office within ten business days of receiving a decision of the Ethics Commission finding a violation and imposing a penalty.
  1. Any person who has filed a complaint with the Ethics Commission and has subsequently received a written decision by the Ethics Commission dismissing the complaint pursuant to SMC 01.04B.200.B may file an appeal to the City’s Hearing Examiner by delivering a written notice of appeal to the City Clerk’s Office within ten business days of receiving a decision of the Ethics Commission regarding a written decision dismissing the complaint.
  1. The notice of appeal shall be in writing and shall include the mailing address and, if different, the street address where papers may be served on the appellant. The notice of appeal shall contain, in separate numbered paragraphs, statements of the specific findings of fact, conclusions of law, or aspects of the fine and/or cost bill on which the appellant seeks review, the basis for the appeal, and a brief statement of the relief requested. The person filing the appeal shall attach a copy of the decision being appealed.
  1. Within five business days of the filing of the notice of appeal, the City Clerk shall forward to the Ethics Commission a copy of the written notice of appeal. A copy shall also be sent to the adverse party.
