Chapter 01.05 Civil Infraction System
Section 01.05.120 Failure to Appear
- Entry of Judgment.
If the defendant fails to appear at a requested hearing, the court shall enter judgment against the defendant finding that the defendant has committed the infraction and assessing against the defendant any monetary penalties provided by law.
- Setting Aside Judgment upon Failure to Appear.
For good cause shown and upon terms the court deems just, the court may set aside a judgment entered upon a failure to appear in accordance with Rule 60(b) of the Civil Rules for Courts of Limited Jurisdiction.
