Section 10.48.320 Scope of Police Duty – Immunities Preserved

  1. The issuance of an alarm registration does not create a contract between the City of Spokane and any alarm user, alarm installation company or monitoring company, nor does it create any duty or obligation, either expressed or implied, on the police department to respond to any alarm activation.
     
  2. Any and all liability and/or consequential damage or loss resulting from the failure of the police department to respond to an alarm dispatch request is hereby disclaimed and governmental immunity as provided by law if fully retained.
     
  3. By applying for an alarm registration, the alarm user acknowledges that police response to an alarm activation is influenced by the availability of officers, priority of current calls for service, traffic and/or weather conditions and staffing levels.
