Chapter 12.03 Airport Regulations

Article III. Solicitation Activities

Section 12.03.0402 General Restrictions
  1. No person, group of persons, association, organization, or business entity shall engage in any solicitation of funds, goods, or services for any purpose whether charitable, nonprofit, commercial, or otherwise; nor shall any person, group of persons, organization, association, or business entity distribute literature, picket, display signs, or conduct similar organized systematic communicative activities at Spokane International Airport without a permit issued by the airport’s director in accordance with the rules herein set forth or without a license or lease for a commercial enterprise to be conducted at Spokane International Airport. A commercial enterprise is any person, group of persons, association, organization, or business entity who engages in any profit-making activity whether involving an exchange of property, rights, services, or otherwise, and does not currently qualify for exemption from taxation under section 501(c) of the Internal Revenue Code of 1954.
  1. No person, group of persons, organization, association, or business entity, whether present at the airport pursuant to a permit, license, or lease required by subsection (A) of this section or otherwise shall obstruct, impair, or interfere with the use of the airport premises by persons or vehicles passing therethrough. Obstruction, impairment, and interference with the use of the airport as used herein is limited to:
    1. prevention of access by others to facilities, amenities, or public areas of the airport;
    1. prevention of normal and customary operations and activities at the airport;
    1. physically blocking ingress to or egress from the terminal or any public area at the airport; or
    1. causing substantial delay in the flow of pedestrian or vehicular traffic;

but in no event shall ordinary attempts to engage in communication or social intercourse constitute obstruction, impairment, or interference with the use of the airport premises.

  1. Any applicant for a permit required by subsection (A) of this section shall, as a precondition of the issuance of a permit, sign an indemnification and hold harmless agreement which shall undertake to indemnify the Spokane airport board, the City, the County of Spokane, their elected and appointed officers, agents, and employees, against any claim that might be made against any of the foregoing by reason of activities conducted by the permittee or its agents at Spokane International Airport, unless said claim is proximately caused by the negligence of Spokane International Airport or its agents.
