Section 12.09.140 Fees and Charges
RCW 35.21.860 addresses limitations on the City’s power to impose franchise or other fees on some service providers and other entities specified, including site-specific charges pursuant to agreements with a service provider of personal wireless services as provided therein. Except as may be preempted by state or federal law, the City reserves the right to require compensation for use of the right-of-way as a condition of granting permission to use and occupy the right-of-way or other permitted areas.
