Chapter 17D.060 Stormwater Facilities

Section 17D.060.080 Administrative Hearings Track – Notice of Hearing
  1. The administrative hearings track is initiated by a notice of hearing. Whenever the City has reason to believe that a violation of this chapter has occurred, a written notice of hearing is prepared and sent to the responsible party or parties as identified by the City.
  1. The notice includes the following information:
    1. The date, time, office, and place for the hearing and information to contact the hearing official. The notice shall further explain the notified party’s opportunity to come to the hearing and/or file a response with supporting materials, where to file the materials, and the deadline, which shall be no later than the hearing date and time.
    1. The date of the notice, which is when the notice is mailed or sent.
    1. A general description of the onsite stormwater facility.
    1. The address of the premises connected with the violation and any other address being notified.
    1. A description of the violation believed to have occurred, statement of the penalties applicable to date, and any penalties continuing to accrue for an uncorrected violation, and any other pertinent consequences and information; and
    1. Advising that the purpose of the hearing is to determine whether there is a violation of this chapter and that as a result of the hearing, an order may be issued directing the violation be corrected, and that if satisfactory action does not occur, the City may thereafter correct the problem and costs thereof may be added to the utility bill for the premises concerned.
