Chapter 17D.080 Voluntary Impact Fees

Section 17D.080.010 Findings

The city council makes the following findings after due consideration and public hearing:

  1. Property developments in the City increase the demand for and use of City streets, parks, open spaces, recreational facilities and fire protection facilities by bringing additional residents, visitors, businesses, employees and customers into the City; and
     
  2. Increasing demand brought about by property development decreases the availability, productivity and usefulness of existing public facilities for present and future citizens of the City, straining municipal resources beyond their capacity; and
     
  3. It is necessary to regulate property developments to improve public facilities through mitigating the direct impacts of developments; and
     
  4. It is within the police power and other lawful authority of the city to regulate property development for the benefit of the public health, safety and welfare.
