Chapter 17D.080 Voluntary Impact Fees
Section 17D.080.120 Enforcement
Where a development has been identified as having a direct impact on public facilities and an impact fee has not been agreed to between the parties, the department requesting the impact fee may require additional studies or place conditions on the project related to impacts. The person with decision making authority may deny approval of the development for failure to either mitigate the impact or agree to the impact fee. No development permit is issued when a department denies approval pursuant to this section. The developer may dispute or appeal this determination pursuant to SMC 17D.080.110.
