Chapter 17E.010 Critical Aquifer Recharge Areas – Aquifer Protection

Article III. Underground Storage Tanks

Section 17E.010.280 Spill Prevention and Protection
  1. The options in subsection (B) of this section shall apply whenever the fire official finds:
    1. a violation of this article;
    1. reasonable cause exists to believe a spill or seepage is occurring (SMC 17A.020.180);
    1. a leak test failure for a UST (SMC 17E.010.230);
    1. a selected monitoring method is either not effectively monitoring leaks or discloses a leak or possible leak;
    1. other environmental risk.
  1. Under any condition provided in subsection (A) of this section, the fire official may order any or all of the following:
    1. Further approved leak testing.
    1. Implementation of additional approved monitoring methods.
    1. Removal of UST contents.
    1. Cleanup of spills or seepage.
    1. UST reinforcement, modification, repair, or replacement in accord with approved City standards.
    1. Prohibit further usage.
    1. Revoke or suspend a permit or impose restrictions or conditions on permit privileges.
    1. Any other measure deemed reasonably necessary to protect the public health and safety or accomplish the purpose of this chapter.
  1. Additionally, when the fire official determines a need, the top of the UST installation may be ordered exposed to check for leakage. If the leak is easily reparable (e.g., tightening bungs, repairing fill pipe, etc.), and the fire official determines it does not appear to be caused by corrosion, tank failure, or other problems requiring major repairs, the repair may be allowed. The fire official may require such further testing, monitoring, and certification or proof as deemed necessary to verify the source of a leak or leak potential is corrected.
  1. If, in the opinion of the fire official, a leak or leak risk is created by corrosion or some other unknown cause, the tank and associated structures may be ordered removed from service and/or otherwise safeguarded or abandoned.
  1. UST tanks and associated underground piping shall be permitted to be repaired only once, in accord with standards established consistent with the purpose of this chapter by the fire official. Thereafter, said UST installation must be either replaced or abandoned, in accord with standards established pursuant to this chapter.
  1. This section shall not restrict any other municipal power or right.
